U.S. Court Quashes Attempts to Attack ccTLDs: Federal Judge Agrees with ICANN

Back in July, media reports came in that a group of terrorism victim families who won a $109m in damages in 2003, filled a lawsuit in a federal court in Washington DC and are trying to take control of .IR top level domains and argued these domains to be transferred to them as a part of "assets" of the country of Iran. ICANN defended the suit and succeeded to convince the federal judge that domains are not "assets", therefore could not be seized.

Anybody who know very basics of the internet governance, could tell the Israeli lawyer Nitsana Darshan-Leitner that she has no chance of winning this case from very beginning and most probably she knew it herself, but there is always free money to be made for lawyers and good PR, no matter how silly it looks or impossible to pull off.

در جولای گذشته، اخباری مبنی بر شکایت گروهی از خانواده های قربانیان تروریزم که قبلا موفق به دریافت حکمی ۱۰۹ میلیون دلاری بابت غرامت از دولت ایران شده بودند، طی شکایتی در دادگاه فدرال در واشنگتن دی سی، خواهان مصادره و در اختیار گرفتن دامنه های اینترنتی .ir ایران به عنوان دارایی های این کشور شده بودند. سازمان ICANN با موفقیت از این شکایت دفاع کرده و موفق شده که قاضی فدرال را راضی کتد که دامنه ها دارایی کشور ها نیست و بدین ترنیب، قابل مصادره نیز نمیباشد.

هر کسی که کوچکترین اطلاعی از شیوه اداره اینترنت میداشت، میتوانست به وکیل اسراییلی پرونده بگوید که این شکایت ره به جایی نخواهد برد و از همان اول کار، امکان پیروزی برایش وجود ندارد. شاید هم ایشان به این امر واقف بوده، ولی همیشه برای وکلا شکایت ها بلاخره درآمدی به همراه دارد و پوشش خبری جذاب، هرچند که شکایت امکان موفقیت نداشته باشد.
